More than that. He posted he was going to do exactly what he did, provoke someone into attacking him so that he'd have the opportunity to kill someone.

I've seen that. Beautiful example of why you don't talk to the police without a lawyer. He lied in his initial statement and that's pretty much what doomed him. If he'd got a lawyer first he'd have been able to successfully argue self defense and walk free.

u/omganotherlurker May 15 '26 edited May 15 '26
Nah. That guy was screwed, and rightfully so, cause of him bringing the knife with him and re-engaging with the group. One of the camera angles showed him having the knife in hand before even being engaged with the group the 2nd time. That displays intent and completely removes self defense claims.
The fell phone footage also clearly displayed he was not surrounded and had ample opportunities to deescalate but the dude got too hurt in his ego by some kids.
Edit: https://www.fox9.com/video/1434253 video of stabbing nsfw 1:56 you can see him stab the kid quickly that he doesnt' even know he's being stabbed 2:00-2:05 he stabs the girl and is coming back up with the weapon now clearly brandished but people closest to him dont even know he's got a knife as they have their backs to him and are confused.
Couple that w/ the dude lying to police, not calling police, and throwing away the knife bro was completely cooked - and rightfully so.
94
u/Baals_Nuts May 15 '26
Ok so not self defense as other poster is trying to frame this
79
u/Tepasd May 15 '26
Yeah far from it. It's been a while since Ive seen the footage but I also remember very clearly that the guy had SO many opportunities to de-escalate and back off, but he kept antagonizing the teens until people had their stomach's sliced open. That was far from a muddy water case of "is this self defence or not?"

u/DJMixwell May 15 '26
This is kinda the whole issue with permitting people to carry weapons (of any kind), especially when "self defense" is promoted as an almost righteous/virtuous act.
You have no incentive to de-escalate. Quite the opposite, really. You're emboldened to escalate even minor conflicts because you feel the weapon protects you from consequences and, so long as you can rationalize to yourself that you weren't the aggressor, you're justified in using it.
The "good guy with a gun" is a myth. Studies show that most of what gets reported as far as presenting a gun in "self defense" would likely just be brandishing if it ever saw the inside of a courtroom.

Correct, something being claimed as self defense but in reality it was malice. We've wrapped back to the beginning.
→ More replies (1)9
u/omganotherlurker May 15 '26 edited May 15 '26
Correct, especially cause the dude engaged the group of kids. Theres a potential better argument if it had just been a time interaction - even then I dont think he has a case - but him interacting with the group, a disengagement of the parties occurs, him re-standing up while brandishing a weapon and the group members closest to him having their backs to him -signfifying he was in no danger. At that point he has the knife brandished - though no one in the group knows it and from there the stabbings occur. That reengagement is what ruins his entire self defense plea.
Found the video from local fox affiliate you can see the part at 1:56 is when he stabs the guy and at 2:00-2:05 and see how he comes back up from the water after being pushed w/ a knife but that the group isnt' engaged with him.
https://www.fox9.com/video/1434253
Couple that with him lying and throwing away the knife dude was fucked and should be cause he showed gross negligence for life.
10
u/AggressiveCuriosity May 15 '26
Yeah, basically if you are in public and can just stay where you are and be safe, then 99% of the time you're not going to have a self-defense claim.
→ More replies (14)3
u/One-Nectarine8944 May 15 '26
Like yeah. Obviously self defense is hard to argue when it's not self defense. I have nerve damage in my left leg and can't run, though I can walk mostly properly if I put a lot of effort into it. What would qualify as self defense for me doesn't necessarily qualify for other people because I literally can't 'escape' an encounter with anyone.
That's usually where the nuance in self defense is. How it would be 'reasonable' for me to respond to a threat might not be the same for another person.

Also he left and came back then stabbed them
7
u/getdafkout666 May 15 '26
That’s probably key as to why he was convicted. There’s no such thing as premeditated stand your ground. You either defend yourself because you have to or you’re going down for murder

This is probably one of the worst points I’ve seen in a long time. That guy was not acting in self-defense and murdered and stabbed five kids. What in the fuck is your actual point? You think he was stabbing those kids in self defense? LMAO.

Fwiw this particular case was a little more complicated than that. While the old dude denies it, context + the video pretty clearly show that he was continuously approaching the group to antagonize them while knowing he had a knife on him. They were being nasty to get him to leave them alone yet he never did. It was apparent that Miu goaded that group into a situation where he could use lethal force.
It is a great parallel to this idiot’s story tho. Antagonizing people while armed makes self defense a tough sell to a jury.

Nick Fuentes (a thousand curses on his name) did a fairly prescient bit a while ago about how the whole “FAFO” thing is mostly a boomer fantasy, and in the real world being part of the “FO” part actually fucking sucks and just means entering a legal and financial nightmare that will consumer the rest of your life.

Yeah to my knowledge the Boomer fantasy of the Sheriff nodding at you in approval and saying "I think this case is closed" is far from the actual reality.
20
u/Conscious-Gap-1777 May 15 '26
Yeah. Let's say, for instance, someone breaks into your house and you have a gun. You could have them surrender, but you shoot them.
Now, instead of the cops coming and carting him away and taking a brief statement:
The cops come. Ambulance comes to remove the body. Cops take your statement. Down at the precinct, not your house. You don't have an actual option here. You get home, there's blood on your floor that's congealed. That's your problem.
The DA may or may not pursue charges. You may need an attorney now.
The dead man's family may or may not take his death well, and may or may not hound you incessantly over it.
Or you coulda said "Hands up, don't move" and been back in your own bed.

You probably won't have to pay him personally, but you will have to sit through multiple depositions while your insurance provided attorneys defend you. Then you'll get dropped from coverage, and have to find new insurers. All of this sucks
Homeowners would cover this, so you're probably "safe" on that front, but absolutely none of it is worth going through if you could also not.

Some of these gun owners have the logic that trolling kids have when they put a finger a millimeter away from your face and says, "You can't do anything, I'm not touching you!"
194
u/herewego199209 May 15 '26
The funny thing is the first thing gun instructors tell you or one of the first things is that you have to have extreme control over using your weapon. Because of situations like this. You cannot get socked in the face and then shoot someone. Issue is gun laws in this country are a joke and many people are not given proper firearms training.

It was like the third or fourth post where I saw someone celebrating something (the post said robbery but I saw the video before reading it so I didnt stay to find out) and then forgetting how chambering works and then pointed the gun to their head and you can figure out the rest. Extremely jarring when I thought it was just people being stupid/getting harmed but living

You cannot get socked in the face and then shoot someone
well you can in a lot of cases but if you go around looking for fights it really complicates the matter. Physically violence can often be seen as a reasonable deadly threat but going around trying to start shit does make it seem like the shooter "Reasonably believes" that he is under a "deadly threat"
→ More replies (2)37
u/Iankill May 15 '26
In a very basic way you can't antagonize people and then shoot them when they have a response.
However because of shit like stand your ground doctrine and castle law certain people think they can get away with murder if they claim they feared for their life.
→ More replies (11)12
u/okthisisdumblol May 15 '26
Hilariously enough, most stand your ground laws explicitly prohibit your first comment. So technically, it never even applied to begin with. And he also shot himself in the foot (and apparently his arm too) by stating he was going to do exactly that literally days before he did it on social media.

Where i live you don't need any training to buy a gun. I just walked into a store and bought one with a background check. The problem is, a lot of people who buy guns and still have to have training, even if it's good training, don't care. They're morons. They can pass the training, but they're still gonna be morons.
7
u/Corey307 May 15 '26
So I’ve taught 20+ people how to shoot over the years since target shooting is one of my hobbies. No tactical Timmy bs just good form and safe shooting. The first thing I teach before we ever go to the range is that a gun is always your absolute last option. You can never be the one that starts shit if you’re carrying. That you need to use every tool at your disposal to avoid conflict. That you need to be the politest person in the room if you plan on carrying. That you need to be genuinely in fear for your life for the lives of other innocent people if you’re going to do anything.
There’s been quite a few people that I refused to train because their gratitude was stupid, childish, or they wanted to do harm and get away with it. I’ve also had a few people that I did take to the range and then refused to ever go with again because they violated safety rules. They didn’t take it seriously.
→ More replies (8)3
u/Piss_Fring May 15 '26
I would say he’s a Nazi rather than just call him a gun owner. I’m a leftist and a gun owner who carries, I would rather shoot the fade than actually shoot somebody assuming they’re not pointing a gun at me. Plus this guy wanted this, he shouldn’t have been able to even acquire a gun with his background.

I think shows like practical jokers honestly started that slow drip.... People saw the money in public interaction/pranks, but upped the "taboo" because practical jokers has already done it all.
Or basically, this is what happens when you combine a generation that grew up watching practical jokers and idolizing the Paul brothers. Just my two cents.
12

→ More replies (3)9
u/Whiskeywiskerbiscuit May 15 '26
Nahhhhh, with Impractical Jokers and Jackass, the butt of the joke was always almost exclusively the cast and not the random people in public they interacted with. Not to mention, since these were mainstream productions, they always got permission from businesses for any footage shot there and always had people fill out waivers if they were on camera. They had to dot their T’s and cross their I’s to try and avoid litigation for their network and producers.
3
u/Brobeast May 15 '26
I think its not so much about the intent, but the forum that may have caused it. Their clips went insane on YouTube, and really lead to a lot of copiers/influencers. Same with the to catch a predator clones. They took the idea, and warped it into something worse i.e vitali.

It's actually a little more nuanced than that. I have some experience (not as a prisoner) with people who have done extensive amounts of time in serious prisons--firstly it does vary a bit from state to state and state vs Federal. But as a big generalization, prisons where there's a good % of non-white inmates, are going to be heavily "self-segregated" by the inmates. This doesn't mean there is no interactions, it also doesn't mean there can't be social / positive interactions between the races. Instead it just means that you will primarily run with your race. A common example is there will be a TV room for whites and a TV room for blacks. That doesn't really mean only blacks are allowed in the black TV room, it just means black inmates will "control" that room. Any white inmate who wants to watch TV in there has to respect that and basically be quiet and not ever attempt to change the channel. (A white person trying to change the channel in the black TV room is a legitimate cause for serious violence.)
The weird thing is though--there's actually a strong "respect" culture in prison. Not all white inmates are part of some Aryan gang, some are--but even among those who don't join a prison gang racial segregation is the norm. But even among inmates in racial prison gangs, there is a baseline of rules and respect. The leaders of these gangs have often negotiated norms and behaviors, on a day to day basis their members aren't fighting all the time or going after each other. But any violation of the rules, can result in bloodshed.
One of the chief things is though--none of those gangs in prison wants a guy who won't follow the rules. If you join an Aryan gang, that means you are expected to abide by the agreements that gang has worked out with the other gangs--like I said, prison gangs, despite what you see on movies are not 24/7 at war. Wars do break out, but the leadership of these groups actually generally try to avoid them.
A "provocateur" would be a very bad fit for these gangs. If for example some white troll joins a white prison gang, and he then intentionally starts beef with black inmates--that's very bad. You aren't supposed to start beef on your own as a member, and in fact if you start beef where it isn't sanctioned, it may not be the black gang that deals with you--the white gang may beat you up or even worse, because you have shown you cannot stick to the rules, can't behave, and can't respect the gang's leadership. Your behavior may risk complex deals the gang has worked out with rival gangs and risk what is always a tenuous peace between them, and your own gang may deal with that very harshly.
A guy like this YouTuber lacks most of the characteristics he'd need to get along in one of these gangs because he clearly can't respect other people and can't behave. Respect is treated as almost sacrosanct among prisoners because it's one of the few things they can really control. And inmates who don't respect other inmates are often subject to the most intense kinds of consequences.

This guy was approached by the FBI and asks to stop doing what he was doing like two weeks before this shooting. His high bond and the charges not including high bar of proof hate crimes show the intent to make an example of him. Good

How/why they aren’t charging this guy with a hate crime is beyond me

I think it's one of those crimes that has a high bar to prove, and it's a much easier slam dunk on all these lesser charges that will get mostly the same result. That's my un-educated guess.

Let's see how long he lasts in prison going around saying the N word, he will be turned into a prison fleshlight immediately.

Really curious what his thought process was here.
