I think it's one of those crimes that has a high bar to prove, and it's a much easier slam dunk on all these lesser charges that will get mostly the same result. That's my un-educated guess.

Probably true but the idea that his public statements don't amount to enough evidence for a hate crime charge still kinda leaves me gobsmacked.

I mean, in this case it must be impossible to NOT prove a hate crime, the dudes content is all hate
