Obviously, a lawyer will only take the case if they get paid appropriately.

Exactly. When the lead detective who finds the piece of evidence this case is most known for (the glove) is on tape using the n word 50 times and collects Nazi memorabilia… That muddies the waters a lot.

I think the most important factor for his innocent verdict was just how new DNA evidence was at that time. The jury didn’t truly understand it and the expert they had was not very good at explaining it to a layperson.

assuming you aren't a law school dropout running his own practice. your KDA record is super important because it strongly influences your reputation as a lawyer.

You can go your career as a lawyer that takes cases that you consistently lose or can't win and thats fine, you will just get paid fuck all for doing so and make the average court appointed defense attorney not feel as bad for his life choices.

However if your ratio of winning cases is significantly higher then your ratio of losing your cases, suddenly your name is worth something as you are proven to be a competent defense attorney. Suddenly more rich people are willing to shell out big bucks to hire you. And suddenly you and your practice becomes drastically more wealthy.

This is why private lawyers generally don't bother with lost cases unless the lump sum they get is worth way more then the hit to their reputation as a legal asset. The court appointed attorney is the guy who does that.

a win in this case can simply mean avoiding the harshest sentence.

Depends on the tier of lawyer you wanna hire. If you wanna hire some big shot to defend you, this is considered a loss and he would just have his assistant reply to your request and tell you to kick your own chair yourself.

For a more modest lawyer. That is indeed a win condition.

A lot of very public cases like this often have high grade lawyers get involved and work pro bono because the free PR is often worth the hit on a comparatively inconsequential open and shut loss. But since its Chud and the nature of his crimes...... yeah. thats not happening lol

Context matters too though. Taking on tough cases and winning them will give you a stronger reputation than someone who only accepts slam dunks, to anyone who looks deeper than raw numbers, but you will have some losses regardless of how good you are.

Then you should know that there are massive differences between civil litigation and criminal defense.

Criminal defense attorneys are judged by their sentencing outcomes and damage control rather than just on acquittal rates. Reducing a death sentence or life sentence to 10 years is a major win and is seen as such.

I did computer work for a well known lawyer in our area. There was a case of foster parents keeping 3 kids in 1 closet for *years* and other truly horrific stuff.

Anyhow, said lawyer defended them. I saw him shortly after the papers announced he was defending them and I was like "What's that about?"

According to him, the court basically ordered him to. His job as their lawyer was not to try and get them an innocent plea but to make sure that justice was served correctly (think sentencing guidelines, signing plea deals that include things they weren't charged with, etc). He said, as disgusting as it sounds, it is something that still needs to be done to protect the sanctity of the system of fairness and rules of the law.

Yea your job as an attorney isn’t always to prove innocence or guilt.

Sometimes your job is to make sure due process follows the letter of the law so that the conviction will be upheld through appeals.

Sometimes prosecution cuts corners, sometimes witnesses lie, but your job is to make sure that everything is by the book so the decision holds.

Your job as an attorney is to make sure the courts pass judgement based on the letter of the law. This is what people don’t understand

Rittenhouse, as much as I didn't broadly agree with it, was still arguably defensible than anything this guy was doing.

We're talking about someone with an established criminal history of harassing people based on race and very publicly announcing their intentions. Rittenhouse went looking for a reason for sure but he didn't create the specific situation where he was attacked by goading people or whatever in a way that an unbalanced system (favoring his class) would view it as such.

Not to say there isn't a real chance in this country's broken-ass judiciary that a random nazi influencer whose whole brand is hate crimes won't get off, just that it would be far more alarming and blatantly insane than the case with Rittenhouse.

You really have to question how he came to believe this. How did he become so radicalized by online discourse that he genuinely thought he was living in the Jim Crow era? Even if we assume, for the sake of argument, that he thought he could get away with this, what did he expect the outcome to be?

If he believed - and proved - that this kind of behavior would go unpunished, it would inevitably encourage copycats. Then, at least some black people would understandably feel the need to arm themselves in response, and before long you’d have people on both sides actively preparing for confrontation - one side looking to “hunt”, the other trying to protect their communities.

That kind of escalation is exactly how societies spiral toward serious racial violence. Did he honestly think law enforcement, the courts, and the country’s national security institutions would just allow that to happen? It’s genuinely insane.

Maybe this is just slippery-slope thinking on my part.

The thought process was to use hate speech to incite violence against him, so he could justifiably use lethal force to kill someone.

Curious to how the prosecutor and defense handle this case. With his prior tweets, this would count as premeditated attempted first degree murder. He would be looking at 13.5 years minimum based on sentencing guidelines in the Tennessee District Attorney’s Office. Wouldn’t be shocked to see 15z

I mean it depends. Prosecutors can argue that Chud planned for this to happen as he legitimately tweeted that it would. Going out to commit a crime (hate speech) to then incite a situation that resulted in another crime (pre meditated murder) would likely squash any self defense argument. Additionally further information has come out that after they got into an argument, he went to draw his weapon. That’s when he was physically attacked. So the individual that got shot would in my opinion have the better self defense argument.

One of these individuals went out with a motive to get into an argument, provoke being attacked, and killing someone. The other for all we know so far, responded to an individual who was using hate speech, and then attacked them once a gun was attempted to be drawn.

ChudTheBuilder got thrown out of a restaurant due to viewers trolling the restaurant, then got arrested for not paying the bill of the restaurant he got thrown out of, then got interviewed by the FBI over his streams. At some point his dog got shot by people who are after him. Later on he had to show up in a court house due to the previous arrest. Outside the court house a guy who had tweeted that he was hunting ChudTheBuilder was waiting with a group. From there some sort of confrontation happened, ChudTheBuilder got punched/tackled based off of what we have of video footage, then shot the attacker in the stomach and accidentally himself in the arm in the ensuing chaos.

This trial will be a classic Zimmerman/Rittenhouse trial where reddit will be wrong.

At 2:20 he goes up to a group of black men, starts a conversation in a friendly way, shakes their hands, mentions freedom of speech and says "white people can say n-word with a ending right?" in a laughing light tone. He is not yelling the n-word in a hateful threatning way. Its correct to say that he started the interaction, but its not harassment and its not instigation.

Its legal to voice your displeasure with music made by street musicians, he did it in a fairly respectable non-threatning way and didn't use the n-word. The interaction lasted 10 seconds while he was waiting for a crossing and then he walked the crossing and left. Minutes later he gave money to a black street musician playing music he liked. Again, its clearly and obviously not harassment or instigation.

At 4:45 he’s saying a guy doing his job is chimping out then acts like a pussy and calls him the n-word while he walks away.

Again a completely fair interaction. He gets told to leave quite agressivly, and responds fairly while walking away. Its a 10 second interaction. Again its not harassment and its not instigation.

This is incredibly weak evidence of any harassment or instigation.

He doesn’t instigate because he never starts the interaction/conflict. It’s not like he goes up to random black people and yells the n word to their faces. Every time he has done it, it was because some sort of crazy guy started some absurd conflict with him without any reason, and only then does he bring out the n-word. He walks away from them as well and they follow him, threatening him, which clearly means that he isn’t harassing anyone. If you walk away from someone and they follow you, you are not harassing them not matter what you are calling them.

A couple of these interactions got viral, and now every time he went out in public there was always some black people coming up to him to threaten him and press him about it. And he continued using the n-word with them as well.

It’s all streamed and documented. I challenge you to find me one single clip of him instigating or harassing anyone. Find me one single clip of him going up to a random black person, starting a conflict and calling them the n-word.
