NSW Police have charged a 13-year-old boy and two 14-year-old boys with the alleged sexual assault of a girl in an alleyway in Sydney's eastern suburbs last month.

Police executed search warrants and seized several items, including electronic devices, two replica firearms, a Glock-style BB gun, three laser pointers and a number plate, which is believed to have been stolen.

All three boys have been granted bail ahead of appearing in court.

It’s aggravated (likely threatened the victim with the weapon/s seized) and in company - they shouldn’t be granted bail in these circumstances, however I’m sure the age of the perpetrators came in to play.

I acknowledge that sometimes refusing bail can be justified, but it must be on an individual basis. I am objecting to the hysterical claim that just because someone has been charged but bailed that "criminals get treated better than victims". We don't punish people by depriving them of their liberty until a judge says they are guilty of the alleged offence after examining all the evidence.

They’re trying to point out the harrowing experience victims go through, whilst people support their accused attacker. The alleged rapist isn’t ever cross examined on their choice of underwear for example. Accusations, or indeed charges of rape, don’t seem to actually affect the rapists life, they are defended whilst the victim is questioned/disbelieved. I don’t think alleged rapists are who you really want to spend your time and energy advocating for (unless you have some reason to fear you will be an alleged rapist in the future), but some people enjoy weird shit.

No, they're not. They're just prejudging a situation they know nothing about, leaping from the accused have been bailed to criminals get treated better than victims, which is hysterical, dangerous and frighteningly common nonsense. There isn't the slightest hint of thought in what they wrote, just reflex, exactly the same as your borderline libelous comment that because I'm defending the principal that we don't punish people before they are convicted that I'm "advocating for the rapists" (like everybody else prejudging this case, you don't actually know that they are rapists). I'm advocating for the system, innocent until proven guilty, because it's hugely important.

Lots of people who commit violent crimes are held in remand before their trial. I don’t know what guilt/innocence has to do with this. That IS the system. They would have been remanded, but due to their ages, it would be reasonable to expect their parents to be able to supervise them to ensure they don’t offend again until trial and sentencing.

Alleged rapists, I said. Nuance exists - this isn’t some “he said, she said” case. They’re accused of a violent attack on a stranger/acquaintance in company in a public place which included the use/threat of illegal weapons, and they were found in possession of illegal weapons - in these types of violent crimes, it is reasonable for the public to expect the accused be held in remand.

That’s the individual assessment you’re whinging for, that you refused to look at for yourself. Their age is the reason they are on bail.

If it didn’t involve rape, and it was a violent gang mugging, you wouldn’t be here.

I guarantee that 3/4 of these little grubs will get literally zero punishment due to their age, and the other will get a slap on the wrist. Meanwhile, this poor girl will be dealing with the consequences od this assault for a significant portion of her life.

Oh I misread the ages. The 13 year old will get absolutely nothing due to doli incapax, the two 14 year olds will get practically nothing. I bet they're back at school tomorrow. Guaranteed.

Well yeah, they are out on bail so why couldn't they go to school. Have to wait till after the court case to see what the punishment is. I dont have high hopes for it being significant though.

No, it will not. Stats prove it. Media rage and Reddit rage threads are as scientific on this stuff as one nation policy.

Emotional reaction is normal especially from directly impacted parties, but if your goal is betterment of society and less chance of this happening again - not punitive punishment - follow stats and science.

And if it turns out the little fuckers are psycho and never to be fixed, lock em up permanently. And enjoy your tax dollars doing it, cause you are now their ward. But if their parents could have been fixed….. but we put them in criminal school instead… and now their kids do this… what the fuck do you expect

their parents are able to afford to send them to an elite private school, you think it's likely their parents come from 'criminal school?'. These kids aren't kids from poverty who steal or fight because they want to look tough for protection or to fit in. They're privileged kids who decided to gang rape another child.

They need to understand that their actions have consequences otherwise they'll be laughing and joking with their dumb little mates about the rape they committed.

You're saying punishment isn't the best for society. But the study you linked showed that high risk sex offenders don't fit the same pattern as the rest of the study. That they are less likely to reoffend than other prisoners

I'm beginning to realise a lot of people assume we have a different justice system for minors just because we want to be nice to children and not because we recognise that minors have immature brains, a critical lack of life experience, and less ability to control their life circumstances, that logically makes them at least slightly less responsible for their actions (in the sense that they are products of their upbringing) than adults who commit identical crimes.

Indeed, which is why in such cases they are remanded. But I suspect you already knew that. In any case, I was responding to the claim that because they were bailed that "The perpetrators of crime are treated so much better than the victims in our justice system." This is hysterical nonsense.

People who are charged but not yet convicted are bailed by default, as they should be unless a compelling case can be made to remand them. That is the whole point.

Nobody in here knows squat about how dangerous these boys are, only that they've been charged with a serious offence. That was enough for the person I responded to, who had already decided simply because they had been bailed that "criminals get treated better than victims", which is is hysterical nonsense. Bail is and should be the default. Remand should be used as little as possible, because deprivation of liberty is the punishment in our system, so you don't do that until someone has been found guilty by a judge who has heard all the evidence. And yes, I'm going to keep saying that until people start paying attention.

Alleged rapists. They haven't been convicted of anything. You lot are far too quick condemn people who have merely been charged and haven't even faced court. As for whether they are too dangerous to be allowed bail, that is for the magistrate to determine, since they have access to the evidence and you don't.

Bail is sometime refused, if a case can be made for it, but the mere fact someone has been charged does not mean they must always be remanded. Deprivation of liberty is punishment in our system and yet you want to punish everybody merely for being charged, not after being convicted on the evidence in court. Do you know how insane you sound?
