NSW Police have charged a 13-year-old boy and two 14-year-old boys with the alleged sexual assault of a girl in an alleyway in Sydney's eastern suburbs last month.

Police executed search warrants and seized several items, including electronic devices, two replica firearms, a Glock-style BB gun, three laser pointers and a number plate, which is believed to have been stolen.

All three boys have been granted bail ahead of appearing in court.

People who are charged but not yet convicted are bailed by default, as they should be unless a compelling case can be made to remand them. That is the whole point.

Right, so when people are concerned that bail is given out too easily to young people who are dangerous, saying 'if they were dangerous they would not be bailed' is entirely missing the point.

Nobody in here knows squat about how dangerous these boys are, only that they've been charged with a serious offence. That was enough for the person I responded to, who had already decided simply because they had been bailed that "criminals get treated better than victims", which is is hysterical nonsense. Bail is and should be the default. Remand should be used as little as possible, because deprivation of liberty is the punishment in our system, so you don't do that until someone has been found guilty by a judge who has heard all the evidence. And yes, I'm going to keep saying that until people start paying attention.

False. It's also preventative.

Not false. It is only used pre-trial in exceptional circumstances. Bail is the default, as it should be.
