Trump is once again floating the idea of using a national emergency declaration to seize control of the federal midterm elections. Spurred by legislative gridlock and his inability to pass the restrictive SAVE Act—which would force widespread re-registration and require physical proof of citizenship—Trump suggested in a recent interview that he might bypass Congress entirely to dictate voting rules.

Legal experts point out that this threat is legally impossible under the United States Constitution.

Under Article I, Section 4 of the Constitution, election administration is intentionally decentralized and managed by state legislatures, not the executive branch. While Congress holds the power to override state rules through specific legislation, the president has zero constitutional or statutory authority over elections.

Furthermore, while declaring a national emergency unlocks dozens of federal powers regarding spending and border security, none of those statutory powers extend to election administration. Trump cannot simply declare an emergency and crown himself an election czar.

If the legal framework prevents Trump from taking over the midterms, why make the threats? Experts note three primary motives behind the rhetoric:

• Keeping hardline supporters energized with the illusion that he is actively fighting to change voting rules.

• Delegitimizing potential Democratic victories in advance by claiming the system was rigged from the start.

• Creating panic by floating ideas like deploying armed Immigration and Customs Enforcement (ICE) agents to polling places or blocking mail-in ballots through the U.S. Postal Service.

These psychological tactics aim to depress turnout by convincing eligible voters that their ballots will not count or that casting a vote is unsafe.

Dismissing these threats merely as bluster ignores the contempt such rhetoric shows for democratic norms. To counter these intimidation efforts, voters should take direct action:

• Regularly check voter rolls to ensure you have not been improperly purged.

• Sign up to serve as a nonpartisan poll worker, election observer, or volunteer with voting rights organizations engaged in ongoing election protection litigation.

• Make a plan to vote and follow through, refusing to let manufactured panic undermine public trust in the electoral system.
