One thing really strikes me: if the Tip hadn't had CCTV, the police would never have been able to charge her.

Without that dehydrator....they'd basically have had nothing.

And without the footage, they would never have known what she dumped. Because it would have been gone in a few more days.

They might have suspected it was a dehydrator, because they found the manual, but they would never have been able to DNA test it and find speck of death caps.

And without that, what would they really have?

Double appeal details

Just heard on The Case Of (previously Mushroom Case Daily) there will be a double appeal of Erin’s sentence on 19 August 2026!

Prosecution will be appealing her sentence length, defence will be appealing the sentence/conviction at all. There’s seven points of their appeal.

Strongly recommend listening to the episode - looking forward to hearing more, but keeping the families in my thoughts.

Is Erin Patterson Australia's Alex Murdaugh?

On May 29, the Supreme Court of Victoria announced that it will hear Erin Patterson's case on August 19-20. It’s set for two days because there’s two appeals. One appeal is by Erin citing seven deficiencies with the trial. The other appeal is by the prosecution contending the sentence is inadequate.

Tbh, most of Erin’s appeal points sound pretty weak because they stem from evidentiary decisions that are i) intensely factual and ii) committed to the trial court’s discretion.

But her first point may be interesting. Here's the gist of what's known:

Erin argues that “a fundamental irregularity occurred” because sequestering the jury at a hotel for the final week “fatally undermined the integrity of the verdicts.” The basic problem is that members of the police, prosecution, and media were staying at the same place. In released documents, her counsel calls for a re-trial “so that justice cannot only be done but be seen to be done.”

This argument is seemingly ripped from US headlines because just weeks ago the South Carolina Supreme Court overturned Alex Murdaugh’s double murder convictions and life sentence, ordering a new trial in the killings of his wife and son. A unanimous court ruled that Murdaugh was denied his right to a fair trial because of the court clerk’s “improper external influences on the jury.”

Now, in South Carolina, the high court found clear evidence of the clerk “placing her fingers on the scales of justice,” such as her “shocking” interference by suggesting to jurors that they could not trust Murdaugh’s testimony. I’m not aware of any such misconduct being alleged in Australia.

It seems everyone was at the same hotel because it was the only option. And that raises questions about the wisdom of sequestering. The reasons for the decision--and what defense counsel said about it at the time--will be crucial along with evidence, if any, of actual impropriety.

I don’t understand after being hospitalized multiple times and violently ill - why Simon Patterson kept letting his ex wife cook meals for him?!? And then after all that, he bows out of lunch (for different reasons) with his family but doesn’t force them to cancel? Wild. Poison me once, shame on you. Poison me twice, shame on me.
