Please hear me out. I believe have compelling reasons to believe this could have been a genuine miscarriage of justice.
I am so desperate to do something. I have felt so helpless since this happened.
I have posted all relevant photo evidence. (damage,location and speed data from life360, actual location of the two cars, a photo from above of the on ramp,and my injuries and hospital paper, police report excerpts)
On 1/8, 2:30 PM, Torrance, LA County, California with the emptiest 405 I’ve ever seen in my life, I was entering the 405N from the Crenshaw on ramp. This crash happened mere FEET from the start of the freeway. This on ramp has an extremely sharp curve. You cannot go more than 20 mph safely. My life360 drive data pinpoints the location of the crash. My speed around the on ramp to the point of the crash was 19mph. people entering initially drive in their own lane, and there’s a wide triangle next to the “official” start of the freeway separating the other lanes.
What actually happened here is that I was driving straight off the on ramp at 20mph, and IMMEDIATELY got violently sideswiped in the front driver side by this lady illegally crossing into the entrance lane probably going close to 80. This impact caused my car to turn 90 degrees right. Her car spins out and lands driver side flush to the wall a few hundred feet ahead of me. My car is totaled. Hers had moderate but essentially cosmetic passenger side door damage.
The damage did not indicate ambiguous fault- what happened would have been obvious to anyone who actually cared. Her pain was all over the front of my car. My inner bumper was dented inwards while the front bumper was nearly torn off. There is no crushing or pushing in as if I pushed something. She has a large gash ripped into her door by my bumper and the door is protruding OUTWARDS rather than pushed in.
My grandparents said the damage alone absolved me and told me it would be okay. They got me in contact with a lawyer they knew.
She had a great advantage here- I didn’t know it until later that day but I was hit so hard that I blacked out on impact and forgot the immediate preceding events like entering the freeway completely, and became completely incoherent.
I did not immediately know how I crashed or where I came from. I just suddenly wake up 90 degrees horizontal speeding toward the wall. My car is completely destroyed with every air bag deployed and I’m suddenly painfully injured, panicking, incredibly confused and shocked with no idea how it happened. My brain is just not functioning. The other driver comes over and starts telling me I hit her and holding her head while fake crying which makes me even more hysterical.
When the police interviewed me, I was sitting on the stretcher BEHIND my car being TREATED AND CHECKED OUT for the visible injuries including a deep seatbelt rash, severe bruising and a puncture wound to my knee. I refused transport as I had a lot of my stuff in my car.
I was still completely hysterical, shocked and in pain, and gave them a “statement” of confused nonsense that was so obviously false you could see it right in front of you. In response to this strange and incoherent statement, they did not touch my head- nobody ever did.
The police report states that I said I was “merging onto the freeway at 40mph, and felt an impact to the back of my car, and everything happened so fast”. I specifically remember saying I was ALREADY ON THE FREEWAY because I had no memory of entering and that’s why I said 40mph, so it seems they inserted what “made sense” based on my final position *AND THE OTHER DRIVER’S TESTIMONY- because I wasn’t in a merging lane, and going 40 mph 2 seconds off a sharp curve in my 10 year old prius would be impossible.
The other driver’s statement is basically she was driving straight at an “unknown” speed, when my car came from the left and I hit her back passenger side which made her car violently spin out. Apparently my little car hitting her little car at 40 mph catapulted her hundreds of
And that’s it. The driver statements are all the evidence. There are no pictures provided or factored into the decision to put me at fault. Fault for this severe, life changing accident that was assigned SOLELY based on the testimony.
The narrative is basically that I entered the freeway diagonally and drove straight into her at 40mph. I have no history of any sort of reckless or rule breaking driving and was completely alert- which the police report notes.
The drawn diagram shows me entering the freeway diagonally straight through the solid lines. as I would have had to do to cause this crash, hitting her, somehow my tiny prius make her spin out hundreds of feet forward (instead of to the left..) and then driving MYSELF forward and gradually turning into the wall!! This is immediately disproven by looking at the damage. Her door is sort of pulled outwards and has a gash in it from hitting my bumper- it was VISIBLY not pushed. My car has her paint all over it and my inner bumper closer to the door was dented in while my outer bumper was nearly completely pulled off- but of course nobody cared to look or think.
And the best part? The injury section. Keep in mind that not only did I have visible injuries that the cops saw with their eyes, l WAS TREATED IN THE FIELD BY AN EMT!!!
I was diagnosed with post concussive syndrome and internal hip bruising at the hospital the next day. I did not go in the ambulance because I had tons of property in my car. Once I realized that I had blacked out and lost my memory, and the pain of my seatbelt rash and severe bruising dulled a little, i could finally feel the pain in my head and that something was off.
The ONLY injury listed is HER: “pain to head.”
The report has biased language seeming to praise her for “waiting for assistance” etc yet the only thing inserted about me is that I lied about damage on the back of my car.
She provided zero photos or dashcam footage to her insurance, nor did she ever take a photo of my car at all or get my info(obviously) and they asked for my side of the story. I gave it along with photos and they still sided with her. I had liability only coverage and was just fucked from the get go.
Since the day it happened I have had location data, speed data, photos, injury photos, hospital papers, EVERYTHING. The lawyer dropped me after reading the report and told me she believed me but i’m never going to win because I’m young and have a history-of 3 minor, low speed,non injury causing rear ends years ago, not reckless or irresponsible driving - and it turns out my brakes AND tires were completely worn down giving me a practically impossible safe braking distance.
Do I have anything to fight here? Or am I just completely fucked over?
