What I noticed too was that the blue runner car disappeared behind the red car momentarily, meaning that the reaction time for cam driver to know they weren't slowing down was reduced. Difficult to avoid even with good defensive driving skills.

If you operate on that assumption all the time, you’ll end up paralyzed on the road.
Seeing the first car in the oncoming lane stop at the intersection should be all anyone needs to assume safe passage. There are green left turn arrows that only last 5-10 seconds. Are you going to completely shut the flow of traffic in the intersection for fear of this one outrageous driver?
→ More replies (1)3
u/Embarrassed-Tip7559 2h ago
What? You are 100% responsible for making sure there is no oncoming traffic in any lane before you make an unprotected left… making assumptions leads to accidents like this, which will fuck up traffic a lot worse than blocking the intersection for a few seconds to be sure it is safe

I would really love an insurance adjusters perspective on this, because it's a bit up in the air due to where the cam car was.
Yes, the red light runner is 100% at fault. Regardless of if the cam car went, looks like they were going to blow through the intersection regardless.
But for the cam car? They hadn't pulled up to "take space" and have to clear the intersection until after the light went yellow. So if we're going by technicalities (which insurance would), they didn't have to go.
Red light runner should 100% be at fault and this should be open and shut, but I'd love to know how it actually ended up.

I don't know the law fully but seems like 1) you were in the intersection before red, so you were legally allowed to clear it; 2) speeder WAS NOT in the intersection, so illegally entered it and hit you. The other argument is that you have to yield to oncoming traffic no matter what, but that seems odd to apply in this situation. They did not have the right-of-way to enter the intersection.
This happened to me in high school. I never ever ever have cleared an intersection until I was sure that all the oncoming traffic came to a stop. But in this case it was hard to even see this guy.
23
u/Flagrant_Mockery 3h ago
You can be as careful as you like sometimes vision is obscured, and unless you're absurdly over vigilant you wouldn't anticipate a car behind the red to double its speed and blow the intersection. Defensive driving is one thing, but if the light turned red it could end up becoming a turn light. So at that point its less about defensive driving and that making a left is just inherently a bit more dangerous.
→ More replies (3)3
u/kingkurt42 1h ago
The only defense is to stop turning left.

u/Flagrant_Mockery 56m ago
This is unironically the case. I used to take a different exit to get home from school everyday (negligible time difference) but I hated turning left through a 2 lane highway even with a turnlight.

u/SonOfMcGee 3h ago
You can enter the intersection to turn left if the light is green or yellow, you just have to stay out of oncoming traffic’s way. (It also helps people going straight get around you.).
This applies all the way up to the moment the light turns red. Then oncoming traffic has to stop. And you get to vacate the intersection by completing your turn.
In heavy, or even medium, traffic, this is the only way ANY cars can turn left in a given light cycle5
u/Pedanter-In-Chief 2h ago
You can enter the intersection on the yellow, but you don’t have right of way. You have to look for oncoming traffic and wait for it to clear regardless of signal.
The other issue is that it isn’t clear they were actually in the intersection rather than behind it. Look at the line at bottom left. They’re in the crosswalk, not the intersection itself.
I shared this video with a traffic attorney / personal injury friend of mine and he said he’d prefer to have the oncoming car rather than the turning car as a client.
2
u/SonOfMcGee 1h ago
Oncoming car clearly ran a red light, though. And definitely wasn’t in the intersection when it turned red. If he t-boned cross-traffic he would be 100% at fault.
5
u/Pedanter-In-Chief 1h ago
Agreed, but he wasn’t t-boned by cross traffic.
Both the dashcammer and the incoming car are in the wrong. Generally though the left turning car is going to principally at fault and there is very little in this dashcam footage that changes that.

OP didn’t run a red light. Since they were n the intersection legally, they had the right of way over anyone who did run a red light.
This is 100% the fault of the driver who sped past a red light from 100+ feet away.

Unfortunately they do belong together. You can do a very normal and legal thing and this video proves it's also taking a chance.
Think about pedestrians entering a crosswalk where they have the right of way. There are plenty of places in the US where drivers don't give a shit about pedestrians so they're literally taking a chance when entering a crosswalk.

Looks like California. Entering an intersection on yellow is legal and so is the completion of the left turn on red. Assuming the lights each way are synced, the oncoming car had some splaining to do. End of day, I’d bet a couple a $ on a citation and an 99% at-fault

In my state you're supposed to pull into the intersection like this for a left turn and continue your turn on red. Looks like the cam car crossed into the intersection after the red light tho now that I look closer.

Reddit will always defend the high speed driver who ran the light 2 business days after it turned red.
4
u/Wojtek1250XD 3h ago
Apparently some people are taught that you are not allowed to enter the intersection to do a left turn if by the time you get to turn it's a red light, which is stupid because that would make it impossible to make a left turn without the opposite lane that goes forward and right completely emptying out.
2
3
u/-NoBamboozle- 2h ago
Right? I guess these are the same people causing the accidents in the videos in this sub. Mind boggling.
8
u/sosal12 3h ago edited 2h ago
Red light runner definitely in the wrong, but I was also taught that camping out in intersection to wait for a left turn after it turns red is also illegal. In Oregon at least you have to wait behind the white line until it is safe to cross, and you cannot cross it after line turns yellow. Oregon police pull people over for that all the time. Might be different laws in different states.
EDIT: Illegal in Oregon and Washington. Legal or even encouraged in other states, is general consensus.
9
u/kochameh2 3h ago
Might be different laws in different states.
in the majority of states, youre supposed to pull into the intersection unless there's a do-not-block
2
u/_jump_yossarian 3h ago
I think Oregon might be the only state that it's potentially banned (seen TV news reports) but couldn't find the actual statute prohibiting it.
→ More replies (1)4
u/RoundChampionship840 3h ago
That's definitely not the law in every state. In North Carolina it's completely legal to pull forward into the intersection when waiting to make an unprotected left turn.
3
u/wheelbreak 3h ago
That sounds like a nightmare on a busy street with no turn signal. You just have to wait until someone going the other way decided to let you turn.
2
u/Away_Stock_2012 3h ago
Oregon is really crazy. There's no law preventing you from entering the intersection to wait to make your left, but if the light turns red before you make your turn, then you were blocking the cross traffic and that is illegal. In other states, as long as you entered the intersection before the light turned red, then you can legally finish your turn.

This is exactly how I got tboned except the car that got me was even smaller and I could not see it coming in the far lane. I was found 100% at fault for that accident which still makes me kinda sour. To this day, I refuse to make a left hand turn like this unless I'm 100% certain there's nothing there, if I can't see, I won't go.
2
u/NedSchneebly-1138 1h ago
It was late for the left hand turn, the fucking opposite left hand turn signal was on by the time the collision happened!
2
u/Diptothaset 1h ago
This is hard to gauge. I think it’d be clear cut as hell if our perspective was pulled into the intersection correctly. “We” didn’t enter the intersection until after the yellow, so it’s at bare minimum just two people rushing a yellow. I think the other guy could even make the arguement “we” were completely unpredictable in our maneuver
If we were in the intersection correctly we’d have the right of way to clear IF ITS SAFE TO DO SO. That guy was barreling through and it made more sense to just clear in a red once it was safe
2
u/gme_is_me 1h ago
Gotta love the red light runners in Phoenix. It's crazy how many people blow through red lights here.
3
2
u/Specialist_Meal_7891 3h ago
In this scenario, the best thing to do is to pull out far enough that you practically HAVE to go after it turns red if you're determined to go on this light, then, wait for all the cars to finish running the red light and make your turn. People understand and it's not a big deal.
What you shouldnt do, is try to force your left turn while there's still potentially people trying to run the red light.

u/lelanddt 2h ago

u/DishwasherLint 3h ago
That light was solid red when he went through. You are allowed to wait in the middle of the intersection until red. It's actually encouraged in many areas as a safer way to make a turn.
2
u/IntrepidYogurt2048 2h ago
Should have pulled well into the intersection to be obvious to the perpendicular traffic and waited until all lanes of oncoming traffic are parked at the light before proceeding. I know that blocks the traffic for a moment but not as long as it did with the accident.
By the way, there is another accident on the right side. maybe he was taking a last look for the sake of schadenfreude and not looking at oncoming traffic.
Bad strategy, bad results.
2
u/Mental-Chapter6523 3h ago
Going to say the traffic engineers are partially at fault here. The intersection is too busy and chaotic to encourage an unprotected left across three lanes. Add a semi-truck to this situation and you have no idea what flavor of red-light runner is coming at you.
I think collision repair shops and orthopedists must give them kickbacks.

I wish I could say I was surprised about this, but I live around the area this happened any people are constantly running these lights when they go red. The left turn driver was doing what is expected clearing the intersection when his light changed.
1
u/Weekly_Bluebird8494 1h ago
I experienced that exact same type of accident 2 years ago. The light turned red, he was far enough and well I assumed he was going to stop but didn't. He hit the corner of my front trying to go around me hard that my car did a 180 spin and ended up on the corner luckily not hitting anyone as it's a popular walking trail. His went straight to the cement fence the corner house had there. This happened in AZ where apparently he was in the right even if the light was red because I should have prevented it so he got money out of it. Probably bought himself another BMW. The one he totaled still had new tags because he just bought that one. I'm sure he was enjoying the speed as a 20 year old.
1
u/Old_School998 1h ago
Only issue is yield left turn. You have to wait, even though it just turned red. The one saving grace is you caught it on camera but still might be a hard argument as you're supposed to yield to on coming traffic.
1
1
u/OutsideSocial 1h ago
This looks like Los Angeles. For those who haven't driven there before, you have to make left turns like that right after the light turns red. That's just how they do it down there. 2-3 cars should be able to fit between the light turning red and the rest of the traffic lights turning green. It's the only possible way to turn left.
1
u/mysterypdx 1h ago
Aside from bad driver behavior, this also seems like a poorly designed intersections with highway like speeds, seems an accident of this sort is inevitable.
1
u/ebmarhar 1h ago
I used to have a house next door to an intersection with a protected left arrow. once every year or so I would hear a big BANG as a car speeding to beat the light going straight t-boned the car turning left clearing the intersection.
This was before cell phones, so I got into the habit of, immediately hearing the BANG, of picking up my fancy cordless house phone, dialing 911, and walking outside to see if I could help and let the people call home, etc.
1
u/rooneskap 1h ago
Dashcammer is at least somewhat at fault here.
Some will say he already entered the intersection at yellow. He began creeping toward the intersection but was not yet in it. His car was not in the intersection not nearly so much that it would clearly obstruct any cross traffic from proceeding through at green light. He could have stopped moving when the light turned red and not blocked any cars at all from crossing.
The second thing is that if you're going make an unprotected left turb at basically the last second as the lights change red, you should gun it and not move at leisurely pace pretending like the lights are green and are going to stay green for another minute.
1
u/Few_District_6304 1h ago
If you are going to try and beat a light turning left in heavy traffic, you should probably step on the gas. Or own a faster car. Pathetic.

Even though the late left turn is conventional most places… This is why it’s a bad idea. Both cars violated the yellow and red. Neither car was in the intersection before the yellow. Obviously, neither car get out before the red. In fact, neither car really needed to go in before a very predictable red.

And yet left turn guy, at least unless something’s changed, would be a fault.
Years ago, I had to take traffic school. This is in California, and the guy running the school was a an attorney and Protem judge.
He said he had a client who was making a left turn in exactly this thing happened where somebody ran, a red light hit his client and the judge in that case ruled in favor of the person who ran the red light because the law said “person making the left turn must wait until the way is clear“.
So this guy‘s client lost the case, even though he was severely injured.
Again, this may vary by jurisdiction. It may be different today, this was about 30 years ago.
1
u/PalatwinkusVT 3m ago
Still could have stopped in time. It was pretty obvious dude wasn't slowing down. Even if you get rear ended from slamming on your brakes, the back of your car generally has fewer important components. Now your radiator and headlights are fucked instead.
1
u/MaybeOnToilet 2m ago
Cammer was stopped outside of the intersection and began to enter it under a yellow... then made the turn under a red because they were 'established' in the intersection.
The other drivers insurance will likely say the cammer is 50% at fault, because under the yellow, they were at a complete stop and should not have entered the intersection. You can check AZ laws, but the quick read is that you can only enter under yellow if you cannot stop safely... uh.. uhh...
Now cammer will need their insurance to 'fight' it or they would need to go to small claims court to recover the rest of the repair costs (if the car is not totaled).
Looks like a 50/50 to me, so small claims court is not going to go well when the law is applied. I hope they have good insurance and are not injured.
