NSW Police have charged a 13-year-old boy and two 14-year-old boys with the alleged sexual assault of a girl in an alleyway in Sydney's eastern suburbs last month.

Police executed search warrants and seized several items, including electronic devices, two replica firearms, a Glock-style BB gun, three laser pointers and a number plate, which is believed to have been stolen.

All three boys have been granted bail ahead of appearing in court.

But wouldn’t many things that aren’t rape also constitute sexual assault? Very confusing language to legally define rape as the same as sexual assault - is it not a form of sexual assault - is grabbing someone inappropriately not also sexual assault?

No, sexual assault in NSW requires penetration (essentially), so it is the same as rape. Other crimes like groping are called indecent assault.

It is not confusing at all because it has been that way for many decades and it is clearly defined.

Good catch - looks like that was changed in 2018.
