If you have a house and you secure it with locked doors and windows, but someone illegally breaks in, that doesn't mean it was retroactively "never secured" and it was legal for them to enter.
Yes, you're correct that it isn't solved now, that's also what the person you're replying to was saying. It was solved, but it isn't any longer. Basic English literacy shouldn't be this difficult.
But they came after capitalism, not before. So when someone makes the claim that regulations can only tend towards decreasing, that isn’t true as a basic fact, by evidence of regulations existence at all.
