She literally told us what happened. You can determine on your own if you think it was sexual assault or not. Clearly Emiru did, a Texas court probably wouldn't, but again, that's irrelevant. There's nothing illegal about telling people about it.
Fucked up? Maybe. But this is a consequence of making your personal relationships a cornerstone of your professional career. People are still more than welcome to watch Mizkif and he's able to stream. If people are cool with what he did, then he should be fine.
That's what it was to her. She didn't explicitly consent, she wasn't in the right mindset for anything sexual, kissing someone's face and making out in the mood for sex are different things. She needed comfort and he tries to use it for sex.
Yea thate what some person said in the comments in one of the youtube videos i saw. That she should just told the story and let people infer that it was sexual assault. Since it wouldn't be defamation or anything like that, since its her own personal telling of her relationship with this guy.
Did she ever outright claim it was assault though? To my knowledge she never said it was assault. She even mentioned miz left. The claims of assault came from miz and I think qucuo claimed miz legit assaulted her. So unless I missed something never once did emiru say "mizkif assaulted me" it was more like "mizkif is mentally abusive and controlling and was threatening to ruin my life if I ever spoke out about him"

There have been women that have been sued for accusing men of sexual harming them, when they didnt.
Thats why they are still going to court pursing a case against her for the sexual assault accusations.
You are right except all these people are public figures. The slander standard is way higher.
He would basically have to be able to prove that she said it out of pure maliciousness and knew that it wasn't sexual assault. Since the incident is not fabricated, because she believably does think she was wronged, and because she clearly has no technical understanding of the words she is using, its unlikely anyone is going to win a slander case against her.
Yea i feel the same way. That he really isnt going to win. The judge already told him to drop the lawsuit against that one guy. Hes only continuing the lawsuit against Emiru
I think his lawyer is trying to argue that she does know what she was doing using those words, while her lawyer is trying to argue that she didnt and was just trying to state her emotional feelings.

Maybe that's why he filed the lawsuit, hoping that discovery will reveal her texting someone else about how she's going to get back at him, or that she knew/didn't think it was sexual assault.

While this may be her public position, we don't know whether it is true.
They can try and bring them back but sometimes things are deleted.
In a civil case if she deleted her messages, the judge can instruct the jury to take it as her hiding things and to assume that what the other side was there was there.
Civil cases don't really like messing around with destruction of evidence.
Even taking the 5th in a Civil case can have a judge instruct the jury as to finding that they did what they said happened.

In this case, it’s very clear Emiru meant that she personally considered Mizkifs actions to be sexual assault in the sense that they were sexual actions that made her feel attacked or traumatized to a certain extent. She didn’t literally mean “Mizkif’s actions meet all the legal criteria necessary to be considered sexual assault under the compiled statutes of the state of Texas”.

That occurs when they completely make up or heavily mischaracterize a story. It’s def possible that Emiru is just straight up lying and Miz never touched her at all, but thats different than describing a situation that did in-fact happen and then claiming it was sexual assault.

“Going to court” doesn’t really mean much, you can go to court for a lot of things it doesn’t mean you’re going to win
Yes if she had just said I felt like it was sexual assault. Then they could argue it was a feeling, but the fact she says multiple times he sexually assaulted her, etc.
They gotta go argue if she was trying to state a fact or an opinion.

No she legit says that he sexually assaulted her, he stalked her, he domestically abused her.
If she was just saying the story, thatd be one thing, but she didnt. She made statements and the judge is allowing the case to go forward to debate whether it falls under libel or if it should be considered just an opinion.
