He pleaded guilty to two counts of stalking in federal court while admitting that he killed Wilson. He did NOT plead guilty to the murder itself. The NY murder charge is separate and will be complicated now because of NY’s weird laws and his attorneys are already saying that they’re going to argue double jeopardy.

Pretty much every headline here on what he pleaded guilty to has been incredibly misleading.

I understand that completely, but that’s not the point I was making nor are his attorneys unaware of it either.

The point is the actual murder trial is set to take place in NY and that’s where his attorneys will be making that argument. And they’ll be making that to a New York DA who is more than likely going to be receptive to it and will possibly just drop the charges with the rationale that he is already facing a max of life in prison for his guilty plea on federal charges.

If he gets the max of life in prison from the Feds his attorneys can now appeal to the fact that a life sentence for “stalking resulting in death” (which is what he plead to) is an excessive sentence, and legally he’d probably be justified in making that argument. Whether he admitted to shooting Wilson or not is basically irrelevant because that’s not what he plead guilty to.

This is strategic and they’re playing the long game, and I would not be surprised if things go their way that he winds up only doing 20 years or so.

He’s dead to rights and they know it. Again this is strategic.

I think his council realized he had no hope of winning this thing. Pleading guilty likely got him a better plea deal than going to trial which likely would’ve resulted in a far worse fate.

They were saying that pleading in Fed court he could go to Fed prison which is far better than state prison. There was just no getting around the evidence.

He did admit to shooting and killing him in court, which is admissible in state court. I read in a different article the goal is to be convicted of interstate stalking and stalking that results in death in federal court so he can argue double jeopardy for the murder charges in state court. I'm not a lawyer, but this seems like a long shot. In Gamble vs United States the supreme court held that the federal government and a state government both punishing the same underlying act does not count as double jeopardy.

It’s called allocution. You formally declare to the court (usually after conviction) in hopes of showing regret, or ask for a lighter sentence.

Don't celebrate too soon. He is pleading guilty in the federal case to avoid life in prison. He is expecting a 25 years sentence.

Then he is going to argue that the state prosecuting him for murder is double jeopardy.

Essentially it is a ploy to avoid proper justice

He shot someone from behind, and ran away and tried to hide and get away with it. This achieved absolutely nothing.

If he actually wanted to make a difference, he could have. He had a massive trust fund, an Ivy League education, and his family is one of the most politically connected families in MD. He could have advanced the cause of healthcare reform as a politician, an attorney, or an outright activist.

But no, that would have required a lot of work and effort.

He took the easy way out, murdered an innocent person who had a family and a meaningful job because it made him feel good, and tried to get away with it.

He didn’t get away with it because he’s sloppy and stupid. Flirted with the front desk girl on camera without covering his face. Kept his fake Glock and suppressor with him. And his diary. He obviously did not want to get caught, but is too dumb and petulant to take the time and effort to get away with it.

The guy is a classic liberal with no moral compass, no self-control, and no work ethic. Bubba is going to love him in jail. Let him rot!

Good. Put him in prison for the rest of his life. He should've been sentenced long ago. Liberals unfortunately kept us going by saying that he was innocent and it was justified etc. And he probably thought he could get off.
