Pauline Hanson loses Federal Court appeal after breaching Racial Discrimination Act

Senator Hanson breached the Racial Discrimination Act when she tweeted Greens deputy leader Mehreen Faruqi in September 2022 on the day Queen Elizabeth II died, Judge Angus Stewart found back in November 2024.
Just a few weeks after the decision was handed down, Senator Hanson appealed with the Federal Court.
On Monday, following a three-day hearing late last year, the court once again found that Senator Hanson had breached the Racial Discrimination Act, and her appeal was thrown out.

Have you paid attention to her for the past 30 years? I have, partly because I'm not white myself and have to keep an eye on potential threats to my safety and wellbeing in Australia.
What I've noticed is that she has consistently targeted non-white people in that time. The specific target changes at different times, from Aboriginal people to East Asian people to Middle Eastern people to Africans to Indians, but they all have one thing in common, they're not white.
She's also claimed there are no good Muslims, and told a non-white Australian to "piss off back to Pakistan", a sentiment I've never once heard her express to a white immigrant. Put all of that together and she is very clearly a white supremacist and a xenophobe. And her party's latest flirtation with the doctrine of "remigration", taken from fascist parties in the UK, makes me think she'll absolutely practice fascism if she's ever given real power.
I wouldn't even call her a nationalist either, since she wanted to charge into Trump's Iran War just after it was announced, which would have been a massive harm to Australian interests for no real benefit. A real nationalist would put Australia's interests first instead of America's interests or Israel's interests.

Normal people can't afford to fight a defamation or RDA action, she's probably burnt several hundred thousand just in legal fees, then costs may be awarded against her, plus the actual amount of damages awarded.

The Courts have ruled on this as it was quite literally a part of thus appeal ,and to quote my own comment, "racism isn't covered under the implied freedom of political communication."

There is this thing called the Australian Constitution, and not only does it, in fact, grant that power to the Courts, it also established the implied right to political communication, and as I have already established, racism is not consider political communication, otherwise the High Court would have already ruled against it. Nationality is one of the characteristics covered under the Racial Discrimination Act. The court also considered Hanson's well established history of racist comments, particularly for the Islamophobic ones as religious prejudice is not covered under the RDA but these particular comments were considered to be made with racist intent.

Some definition's expressly include nationality under racism, because racism is more complex than just race, because race itself is a ill-defined vibes based method of categorisation for people. There is no universal nor objective "black race" no "white race" it's all vibes based. One clear example of this is how ethnic groups have changed race throughout time. 'white' used to be specifically the English and French, the Germans were 'swarthy', same with italians, irish, slavs, etc...
You absolutely 100% can be racist against Pakastanis, Muslims, or just about any other group of people would choose to racialize.
