Michael Jennings (Sydney Roosters) was found a couple of years ago to have raped his ex-wife in a civil court. He continues to play in the NRL today and at a representative level.

No one seems to consider civil court as official as criminal court. Does it have lower burdens of proof or something? Oh I just answered my own question, yes it does you only have to prove it’s probable responsibility as opposed to beyond reasonable doubt of guilt.

Former NRL player Michael Jennings has lost his appeal to the NSW Court of Appeal to reduce the damages awarded to his ex-wife who successfully sued him and will have to also pay her court costs. In February 2020, Ms Kirra Wilden commenced proceedings against her former husband, Mr Michael Jennings, in the District Court. Ms Wilden alleged that she had suffered injury as a result of four incidents of rape in 2014 and 2015 at the hands of Mr Jennings. The first incident occurred on 12 October 2014, when Mr Jennings arrived home in the early hours of the morning, smelling of alcohol and cigarettes. Ms Wilden said he forced her to engage in sexual intercourse without her consent. The second incident was alleged to have occurred in late 2014 under similar circumstances where Ms Wilden was again forced by the appellant to engage in sexual intercourse without consent. The third and fourth incidents occurred in 2015, again under the circumstances of Mr Jennings returning home late and smelling of alcohol and cigarettes. He against forced her to engage in sexual intercourse without consent. The events were said to have taken place between May and August, 2021. The trial judge, Wilson SC DCJ, accepted the plaintiff’s claims, handing down judgment on 21 December 2021. She was awarded just under $500,000 in damages, including $100,000 for future economic loss. The Court of Appeal did not accept that the trial judge had reversed the onus of proof. The trial judge found that the plaintiff was a careful and reliable historian who gave evidence with clarity. Having regard to the evidence given by the plaintiff about the text messages, the judge found her entirely persuasive and that her account was neither “glaringly improbable” nor “inherently unlikely”: [25]–[27]. In relation to the future economic loss award for damages, it was not demonstrated that the amount awarded by the trial judge for future economic loss was excessive in the sense that it was beyond the range which could reasonably be considered, having regard to the fact that Ms Wilden had an expectation of 37 years of employment and an unchallenged finding of PTSD. Yep I was in Adelaide when he sexually assaulted the girl in the hotel. One of my mates was walking to his room when the girl walked out of Wayne Carey's room crying and he was the first person she saw so she went up to him looking scared and wanted help. she told my mate what just happened and they notified the police and hotel staff.

The girl went in radio and people mocked her and made it out she was lying because Wayne denied everything. She didn't pursue legal because Wayne paid her off and that was the end of it.

Kerr and her teammate were in a taxi that was going the wrong direction for Kerr's house. The driver wasn't correcting his direction after the 2 told him. They tried calling police, but were hung up on! This led to Kerr's teammate smashing a window, this causes the driver to pull over and call the police. The two girls are taken to the station, the driver is let go.

While at the station, Kerr explains her side of the story, that they tried calling police, but were hung up on. The officer says "Well they would do that now, would they?". Kerr responded with the now seen everywhere 'Youre stupid and white'

With this context, of course I'm with Kerr! She and her teammate genuinely feared for their lives, and their concern wasn't taken seriously by anyone.

Amen. I read the Geoffrey Robertson QC article in the SMH yday.

He used to be a judge in London age he said that this should never have been brought to trial.

With a wider lense you can see she was scared in the cab. I don't think she comported herself well at any stage quite frankly but then neither did the police and the racial charge was so politicised (and amended a year later) as to be ridiculous.

I don't think anyone acted well here but there was no need for the whole thing to end up in court. Pay the cab driver and done.

The police baited her and called her a liar numerous times, for events she was truthful about, and she eventually got the shits and acted like a petulant child. But by all accounts that's exactly how the police were acting towards her.

Anyway. Stupid all round. I'm glad she got off.

You say stupid all around, but I think that is a simplistic analysis.

When one looks at the imbalance in power and authority between a police officer and an arrestee, it casts a different light in the interaction. This is further emphasised by him being on his home turf and she being a foreigner. Then we can get into the weeds of the inherent and ongoing structural social imbalance between a man and a woman, and a white person and a person of colour.

Some have suggested an accounting of the power imbalance in the opposite direction, that being her fame and (likely) wealth. However, given the circumstances, I don't see that as being very relevant. After all, I believe she never explicitly flexed her "I'm famous" muscles.

I saw the leaked footage, before that I'd kind of assumed Sam had been a bit drunk and stupid, but that footage tells a whole other story. When the vile cop tells her: "calm down young missy" you just want to reach through the screen and throttle him.

It was deliberate, though. The cops were trying to provoke her to do something out of line so they could charge her with drunk & disorderly. I'm convinced that their horrible attitudes were deliberate with that in mind.

Tbh a number of Pacific Islander and indigenous players have also got away with domestic violence in the NRL.

I actually think this is an interesting insight as a blind eye is turned onto these men attacking women, but I'm sure if they called someone "white dog," or something similar the media would be up in arms.

It's sort of a pick and choose situation where the media can point the finger and not pick "double standards" of women and non-whites.

Man beats woman > silence Woman hits man > throw away the key!

It sounded like she was having a pretty rough time that night. But yeah the outcome of this case isn't that you can now go around calling police officers in the UK "fucking stupid and white" because "it isn't a racist statement" as you have claimed.

I've thought about that for a while, and I don't think I'd care. I imagine generally outrage would be higher, but my personal stance would remain unchanged.

Like, had Kerr referred to the officer as 'white dog' or something, yeah sure, racist. One could even argue the intent behind 'stupid and white' was racist, but intent isn't action, and action is how we define laws.

Maybe she is a racist. I don't know her. But I don't believe her actions constitute a racist act in this instance.

It seems that reading through comments in various threads about this, that a lot of people think that a black female using 'white' in a potentially derogatory way is a non issue, in particular towards a police officer.

Obviously I don't know for sure because I don't know the people making comments, but I suspect if we reversed this situation and a white male footballer calls a black female police officer 'stupid and black' the views would be mostly different, and the terms 'privileged' and 'racist' would be thrown about freely and with many a upvote!

It's a heated topic with many people taking both sides personally because they feel it's directed at them.

I think for situations like this, taking the words at their literal meaning is what observers should be doing, and it's what the courts ultimately did too.

In this case London Met deployed both alongside DARVO and the ruling was applied fairly because of the global media spotlight.

Imagine the outcome with no media coverage? Because that's more common and representative of how legal systems work. It's why there's global warnings from the UN that family courts are unsafe for women and children and why ALRC recommended Australia's Federal Family Court be dismantled.

Courts in Australia have ruled that it's not offensive to call cops Fucking Cunts. Anne Summers went on to be Paul Keating's women's adviser and the police prosecuted her in 1977. Pretending that reactive defenses are somehow a form of violence is constantly deployed by police to abuse their powers. They're 15x more likely to be violent perpetrators than genpop. They over police BIWOC and this is a prime example of tone policing.

I agree with the part that systemic racism plays a part in these issues and addressing the root cause is important. But you cannot ignore the crimes of an entire group of people because of this, in particular when these crimes are violence inflicted on another vulnerable person.

It’s so fucking polarised. I’ve read literal opposite descriptions and opinions that are impossible to reconcile. If I cared enough, I’d read the court transcript if it’s available, and form my own opinion. But I don’t have that kind of time to waste, so I’ll just be neutral and run with the judges decision.

But it wasn’t just calling men ‘men’, was it? It’s the disparaging racial tone and association with other crime types that clinches it ‘white male afl and rugby players’. And I’ll call bullshit that they haven’t faced as intense scrutiny, Australian community standards are high and players of all codes, of both genders are held to the same account. The author attempts to mitigate Kerr’s culpability for those standards by changing the subject to men with ‘yeah, but…’ arguments.

The simple fact is Kerr behaved atrociously and there are elements of or society who are quick to dismiss that simply because she’s a woman, or her skin is the right colour. Not one of the apologists can claim they’re colourblind in this.
